THE HONOURABLE SMT JUSTICE K. SUJANA CRIMINAL PETITION No.12130 of 2025 ORDER:

The present Criminal Petition is filed praying this Court to enlarge the petitioners on bail, who are arrayed as accused Nos.6 and 8 in Crime No.2 of 2025 before the Narcotics Police Station, Warangal, registered for the offences punishable under Sections 8(c) read with 20(b)(ii)(C) and 29 of NDPS Act. 2.

The case of the prosecution revolves around seizure of 210.760 kgs of Ganja which was in illegal possession of accused persons who intended to transport the same to the needy. 3.

Heard Sri E.Nithin, learned counsel for petitioners, and Sri D. Arun Kumar, learned Additional Public Prosecutor appearing for respondent - State.

Learned counsel for petitioners submitted that the petitioners are innocent and falsely implicated in the case. He further submitted that petitioners are women and are sole breadwinners of their families. He asserted that except the allegation that the petitioners assisted the other accused to

arrange a truck driver to transport the ganja, there are no other allegations against the petitioners. Therefore, he prayed this Court to grant bail to the petitioners by allowing this criminal petition. 5.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for petitioner stating that the seized contraband is of huge commercial quantity and the petitioners were engaged in the business of transporting the same with ill-motive of earning easy money. Therefore, prayed the Court to dismiss the criminal petition. 6.

Having regard to rival submissions made and on going through the material placed on record, it is noted that though there is no doubt that the seized contraband is huge commercial quantity, it is pertinent to note that the allegations leveled against these petitioners are that they arranged A4 who is driver of the vehicle in which the ganja was being transported. Except the said allegation, there are no other allegations against the petitioners and the previous case history of the petitioners is also clean. Therefore, considering the period of incarceration of petitioners, this Court deems it fit to grant bail to the petitioners, subject to following the below conditions:

i.

The petitioners shall execute a personal bond for a sum of Rs.25,000/- each (Rupees Twenty Five Thousand only) with two sureties for a like sum each, to the satisfaction of Narcotics Police Station, Warangal.

ii.

The petitioners shall appear before the concerned SHO at 11:00 a.m., on every Wednesday for a period of eight (8) weeks, for the purpose of investigation, and thereafter, as and when required.

iii.

The petitioners shall abide by the conditions stipulated in Section 480(3) of the BNSS, earlier known as Section 437(3) of Cr.P.C.

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
