THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.10097 of 2015 ORDER:
This Criminal Petition is filed by the petitioners - A1 to A7, under Section 438 of the Code of Criminal Procedure, seeking to grant bail in Crime No.722 of 2015 on the file of Malkajgiri Police Station, Cyberabad, registered for the offence punishable under Section 498-A IPC.
Heard and perused the material available on record. The case of the prosecution is that the marriage between the 1st petitioner and the de facto complainant was performed in the year 2008. Thereafter, the petitioners started harassing the de facto complainant by demanding additional dowry and necked out her from the matrimonial house by suspecting her character.
Since the present complaint arises out of matrimonial dispute, this Court is of the view that arrest of the petitioners would cause prejudice in case of future settlement between the parties. Hence, this Court is inclined to grant anticipatory bail to the petitioners.
In the circumstances, the petitioners - A1 to A7 are directed to surrender before the Magistrate concerned on or before 21.10.2015 and on such surrender, they shall be released on bail on their executing personal bond for a sum of Rs.10,000/- (Rupees ten thousand only) each with one surety for the like sum each to the satisfaction of the said Magistrate. Further, the petitioners are directed to appear before the Station House Officer concerned, as and when required.
