HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION NO.1784 OF 2001 ORDER:

This writ petition is filed seeking to issue a writ of Mandamus declaring the action of the 1st respondent in not making payment of petitioner's pensionary benefits as per PPO No.06SGO33002, dated 26.2.1996 even after five years and in claiming that the petitioner's claim for pension is time barred, as illegal and arbitrary, and consequently, to direct the 1st respondent to make payment of pensionary benefits to the petitioner with appropriate interest. 2.
On 5.2.2001, while admitting this writ petition, this Court passed interim order directing the 1st respondent to process the petitioner's claim for pension vide PPO No.33002, dated 26.2.1996, within a period of three weeks from the date of receipt of a copy of the order and pass orders thereon.

When this matter is taken up for hearing, it is noticed that the learned Counsel for the petitioner expired, and the notice sent to the petitioner directly in the year 2010 was not returned. Since this matter pertains to the year 2001, this Court is proceeding to dispose of this matter.

If the claim of the petitioner was processed in pursuance of the interim order passed by this Court on 5.2.2001, no further
orders are necessary in this writ petition. If the claim of the petitioner for his pensionary benefits has not been processed so far, the 1st respondent is directed to consider the claim of the petitioner for pensionary benefits and pass appropriate orders, within a period of four weeks from the date of receipt of a copy of this order. 5.
Accordingly, the Writ Petition is disposed of. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
