HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.26208 OF 2018 ORDER:

This writ petition is filed to declare the in-action of the respondents in taking action on the representations of the petitioner dated 28-11-2015 and 20-05-2017 made seeking to conduct elections to Ceylon & India General Mission Church, Hindupuram, Ananthapuram District, as being illegal, arbitrary, unconstitutional and violative of resolution passed by the earlier Committee and By-laws of the Church and consequently direct the respondents to consider the said representations and pass appropriate orders thereon in the interest of justice. 2.

Heard the learned counsel for the petitioner, the learned Government Pleader for Co-operation and the learned counsel for the 4th respondent.

Learned counsel for the 4th respondent submits that in the affidavit filed in support of the writ petition in paras 4 and 5 the petitioner himself stated that General Body Meeting was conducted on 27-07-2016 and a new committee was elected for the period 2016-2018.

It is to be seen that when the petitioner himself averred that the new committee for the 4th respondent-Church is elected for the period 2016-2018, the petitioner cannot make a grievance for nonconsideration of representations dated 28-11-2015 and 20-05-2017 made by him to conduct elections. The averments made in the affidavit and the relief claimed are contradicting. Even otherwise, learned counsel for the 4th respondent submits that the term of the

elected body of the Church is completed by July, 2018 and the 4th respondent is taking steps for conducting fresh elections. 5.

In view of the same, recording the submission made by the learned counsel for the 4th respondent, the writ petition is disposed. There shall be no order as to costs.
