THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.11836 OF 2025 ORDER :

This criminal petition is filed under Section 480 & 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') by the petitioner/accused seeking his enlargement on bail in connection with FIR.No.260 of 2025 of Domalguda Police Station, Hyderabad District. The offences alleged against the petitioner are under Sections 318(4), 69, 88 and 351(3) of Bharatiya Nyaya Sanhita, 2023.

The case of the prosecution is that on 21.08.2025, the defacto complainant lodged a complaint stating that since three years she along with the petitioner was living together and they are in relationship from the year 2017, during which time, petitioner under promise of marriage abused her sexually and recently she came to know that the petitioner had engaged with another girl. As such, she requested the police to take necessary action against the petitioner. Basing on the said complaint, the police registered the case against the petitioner for the above offences.

Heard Sri A.Malsoor Goud, learned counsel for the petitioner and Sri D. Arun Kumar, learned Additional Public Prosecutor appearing for the respondent-State. 4.

The contention of learned counsel for the petitioner is that petitioner is innocent of the said allegations. Even according to the complainant she is aged 35 years and the petitioner is only 28 years and all the allegations are vague. The complaint shows that from 2017 they are in relation which is nothing but a consensual relationship and it is not an offence under Section 69 of BNS. Further petitioner is in jail from 21.08.2025 and material part of investigation is already completed. As such, requested this Court to grant bail to the petitioner. 5.

On the other hand, learned Additional Public Prosecutor opposed bail stating that the alleged offence is heinous in nature. As such, requested this Court to dismiss this petition. 6.

Considering the submissions made by the respective counsel and the material on record, the petitioner herein is in jail from 21.08.2025 and as seen from the record, the petitioner and complainant are in relationship from the year 2017 and that material part of investigation is completed. Considering all these facts and circumstances, this Court deems it fit to grant bail to the petitioner subject to the following conditions :

The petitioner/Accused shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties for a like sum each to the satisfaction of X-Additional Chief Judicial Magistrate at Secunderabad.

ii.

The petitioner/Accused shall appear before the concerned SHO at 11:00 a.m., on every Wednesday for a period of eight (8) weeks, for the purpose of investigation and thereafter, as and when required.

iii.

The petitioner/Accused shall abide by the conditions stipulated in Section 483(2) of BNSS.

Accordingly, the Criminal Petition is allowed. Miscellaneous petitions, if any, pending shall stand closed.
