HON'BLE SRI JUSTICE U.DURGA PRASAD RAO Criminal Petition No.3603 of 2017 ORDER:

In this petition filed under Section 438 Cr.P.C, petitioner/A2 seeks pre-arrest bail in Cr.No.119/2017 of Kamatipura PS, Hyderabad wherein the petitioner along with other accused allegedly committed offences under Sections 420, 468, 471, 109, 120B r/w 34 IPC and Section 12(1)(a) (b) of Indian Passports Act, 1967.

2) The allegation so far as this petitioner/A2 is concerned, she on the instructions of A1, who is her husband, procured a fake passport by utilizing the services of A3.

3) By producing charge sheet, learned Addl.P.P. would submit that investigation was completed and charge sheet was filed and case was registered as C.C.No.202/2017 on the file of Chief Metropolitan Magistrate, Nampally, Hyderabad.

4) Having regard to the gravity of the offence and conveying of information about filing of charge sheet, it is not a fit case to grant anticipatory bail to the petitioner/A2. She is directed to surrender before the trial Court and seek for regular bail in which case the said Court shall dispose of her bail application on merits on the same day. 4) This petition is accordingly dismissed.
