THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.726 of 2016 ORDER:

This Criminal Revision Case, under Section 397 read with 401 of Cr.P.C., is filed aggrieved by the order, dated 25.02.2016, in Crl.M.P.No.1187 of 2015 in C.C No.416 of 2009 passed by the VII Metropolitan Magistrate, Cyberabad, Hayathnagar, whereunder and whereby, application filed under Section 220 Cr.P.C., to carry out trial in C.C No.416 of 2009 along with C.C. Nos.417 and 453 of 2009 simultaneously as all matters arise out of same transaction, was dismissed.

2. The case of the petitioners is that in all the aforesaid Calendar Cases, the accused are one and the same and witnesses are also one and the same, but, the prosecution has taken up trial in C.C No.416 of 2009 only without taking trial in other two cases

3. Heard and perused the material available on record.

4. Admittedly, the aforesaid Calendar Cases are pending before VII Metropolitan Magistrate, Cyberabad, Hayathnagar and they arise out of the same transaction. In all the cases the accused are one and the same and the witnesses cited by the prosecution are one and the same. Therefore, the Court below is directed to conduct trial in all Calendar Cases i.e., C.C Nos.416, 417 and 453 of 2009 simultaneously and pass judgment on the same day.

5. With the above direction, the Criminal Revision Case is disposed of. Miscellaneous petitions, if any, pending shall stand closed.
