HON'BLE Dr. JUSTICE CHILLAKUR SUMALATHA CRIMINAL PETITION NO.8718 OF 2022 ORDER:

Heard Sri K. Venumadhav, learned counsel for the petitioner as well as the learned Assistant Public Prosecutor.

Seeking the Court to enlarge the petitioner on bail who is arrayed as Accused No.1 in Crime No.177 of 2022 of Basanth Nagar Police Station, Peddapalli District, the present criminal petition is filed.

Learned counsel for the petitioner states that the petitioner has not committed any offence whatsoever and basing on a trivial issue, a false case is foisted against him. Learned counsel for the petitioner also states that the allegation that is levelled against the petitioner and other accused is that a sum of Rs.2,00,000/- (Rupees Two lakhs only) was taken initially from the son of the de facto complainant on the ground providing job and subsequently, another sum of Rs.2,50,000/- (Rupees Two Lakhs Fifty thousand only) was also collected. But neither

job was provided nor the amount was returned and on that, the son of de facto complainant attempted to commit suicide. Learned counsel for the petitioner states that the petitioner is in judicial custody since 07.09.2022 and the investigation is also completed and therefore, he may be enlarged on bail.

The submission learned Assistant Public Prosecutor is that the entire investigation is completed and charge sheet would be laid soon.

Having considered the submissions thus made and as there are no grounds whatsoever to keep the petitioner in judicial custody for a further period, this Court considers it desirable to enlarge the petitioner on bail as prayed for.

Resultantly, the Criminal Petition is allowed. The petitioner/Accused No.1 shall be enlarged on bail on his executing a personal bond for Rs.25,000/- (Rupees Twenty Five thousand only) with two sureties for a likesum each to the satisfaction of the Judicial Magistrate of First Class, Peddapalli. The sureties are directed to submit their two

latest passport size photographs at the time of furnishing solvency. One such photograph is ordered to be pasted in the Surety Register against the name of the surety. The other photograph shall be kept in the case record concerned.

The petitioner/Accused No.1 shall oblige the following conditions:

(i) He shall surrender his passport before the Court below, if not already seized by the police. (ii) He shall give an undertaking that he would not leave the Country till conclusion the proceedings in the Criminal case.

(iii) He should not involve in any unlawful activity. (iv) He should not cause the evidence of the offence disappear.

(v) He should not tamper with the evidence in any manner.

(vi) He should not by way of inducement, threat or promise, dissuade any person who is acquainted

with the facts of the case, from disclosing such facts to the Court or to the Police Officer.

(vii) He should ensure his presence whenever required by the Court or Police.

Any deviation of the above conditions would entitle the respondent to take appropriate steps for cancellation of the bail.

Miscellaneous petitions, if any, pending shall stand closed.
