HON'BLE SRI JUSTICE S.V. BHATT Writ Petition No.19731 2017 ORDER:

The prayer is substantially against respondents 2 to 4. The petitioners rely upon the assignment, possession and enjoyment of assigned property, have filed representation dated 24.04.2017 for consideration and disposal by 3rd respondent. The representation remains unattended as on date.

This court is of the view that once the assignment is completed, as consequence thereof the possession of assigned plot is also given to petitioners. As the interference is from respondents 5 to 9, petitioners seek liberty to workout the remedy of filing a suit against any person interfering with their possession and enjoyment. The writ petition is disposed of by granting liberty as prayed for. No order as to costs.
