THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.10674 of 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioners/Accused Nos.1 to 3 in Crime.No.76 of 2023 on the file of Kuntala Police Station, Nirmal District, registered for the offences under Sections 294-B, 324 and 307 r/w. 34 of IPC.

Heard learned counsel for the petitioners and learned Assistant Public Prosecutor for the respondent-State and perused the record.

The case of the prosecution is that these petitioners have attacked the injured with an intention to kill them, keeping in view the previous disputes in mind. The petitioners were arrested on 03.10.2023. It is not disputed by the learned Assistant public Prosecutor that the injured have been treated and discharged from hospital.

It appears that the disputes amongst the petitioners and the injured are regarding earlier disputes. However, no details of disputes are stated in the remand report.

However, keeping in view that the injured were already treated, the prayer for regular bail can be considered, subject to following conditions:- i) The petitioners/Accused Nos.1 to 3 shall execute personal bond for a sum of Rs.25,000/- (Rupees Twenty Five thousand only) with two sureties, for a like sum each to the satisfaction of Additional Judicial First Class Magistrate, Nirmal, Nirmal District.

ii) The petitioners/Accused Nos.1 to 3 after release shall appear before the concerned Station House Officer, on every Monday and Wednesday at 10:00 a.m., for a period of eight weeks for the purpose of investigation and thereafter, as and when required.

iii) The petitioners/Accused Nos.1 to 3 shall abide by the other conditions stipulated under Section 437(3) of Cr.P.C. 6.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
