THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.10675 of 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioners/Accused Nos.1 & 2 in Crime.No.235 of 2023 on the file of Narsapur Police Station, Medak District, registered for the offences under Sections 306, 354, 323 and 504 of IPC.

Heard learned counsel for the petitioners and learned Assistant Public Prosecutor for the respondent-State and perused the record.

The case of the Police is that the deceased was humiliated and insulted by these petitioners on the street using filthy language. The reason was that the 2nd petitioner suspected the deceased having an illegal relation with A-1. On 22.09.2023, there was a panchayat held and in the said panchayat, these petitioners abused and insulted the deceased and also beat her. According to the remand report, the deceased felt disgusted with the conduct of these petitioners beating her in front of the elders and poured kerosene and set herself ablaze.

The consequence of suicide is alleged altercation in between the petitioners and the deceased and the reason for altercation is the 2nd petitioner being suspecting illegal intimacy in between A-1 and the deceased.

However, keeping in view that the petitioners are in jail since 05.10.2023, petitioners can be granted the relief of regular bail subject to following conditions:- i) The petitioners/Accused Nos.1 & 2 shall execute personal bond for a sum of Rs.10,000/- (Rupees Ten thousand only) with two sureties, for a like sum each to the satisfaction of Judicial First Class Magistrate at Narsapur, Medak District. ii) The petitioners/Accused Nos.1 & 2 after release shall appear before the concerned Station House Officer, on every Monday and Wednesday at 10:00 a.m., for a period of four weeks for the purpose of investigation and thereafter, as and when required.

iii) The petitioners/Accused Nos.1 & 2 shall abide by the other conditions stipulated under Section 437(3) of Cr.P.C. 6.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
