The petitioner is accused in Crime No.288 of 2017 on the file of the Adibatla Rural Police Station, Rachakonda District. The crime is registered for the offence punishable under Section 420 IPC. 2.

Heard the learned counsel for petitioner at length and the learned Additional Public Prosecutor representing the State of Telangana and perused the bail application averments, F.I.R. and the earlier dismissal order of anticipatory bail application of the petitioner in Crl.M.P.No.2651 of 2017 passed by the learned XIV Additional Metropolitan Sessions Judge, Cyberabad, Rangareddy District at L.B.Nagar, Hyderabad dated 03.07.2018.

A perusal of the material record no way enables the Court to exercise the discretion to the grant of anticipatory bail to the petitioner, but for to say while disposal rather than dismissal for the offence not punishable over seven years, the petitioner is entitled to the protection of Section 41-A Cr.P.C. for the police to follow.
