THE HON'BLE SRI JUSTI CE A.V.SESHA SAI W.P.No.26034 of 2018 ORDER:

Heard the learned counsel for the petitioner and Sri Sampath Prabhakar Reddy, learned Standing Counsel for the Respondent Corporation and perused the material available before the Court.

It is the submission of the learned counsel for the petitioner that at the instance of neighbours, the Respondents have resorted to action of demolition of structures, despite existence of validly granted building permit bearing No.3/C12/02453/2018 dated 8.2.2018.

On the other hand, it is submitted by the learned Standing Counsel Sri Sampath Prabhakar Reddy that contrary to the building permit, petitioner herein has constructed third floor and centring work was also undertaken on the fourth floor and the Respondent authorities have removed centring work on fourth floor and pulled down third floor.

With the consent of both the learned counsel for the petitioner and the learned Standing Counsel for Respondent Corporation, this writ petition is disposed of as follows.

The petitioner herein is entitled to proceed with the construction activity strictly in accordance with the Building Permit bearing No.3/C12/02453/2018 dated 8.2.2018. If there is any contravention of the said building permission, it is open for the Respondents herein to take action in accordance with law. 6.

The writ petition is accordingly disposed of. As a sequel, the miscellaneous petitions, if any, shall stand closed. There shall be no order as to costs.
