THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 11715 OF 2017 O R D E R :

The petitioner claims to be the owner and possessor of the land in an extent of Ac.1.00 in Patta No. 44/2, Lingapeta Village, Vajedu Mandal, Jayasankar Bhupalapalli District after the death of her husband Sri Chinna Sammaiah. The said land was wrapped with sand due to floods occurred in 1986. While so, the unofficial respondents have applied to the authorities for de-casting the sand and started digging sand from her land forcibly. Though the petitioner made several representations to the District Collector and the Project Officer of Telangana State Mineral Development Corporation Limited, Warangal, the 4th respondent Mandal Revenue Officer has not prevented the unofficial Respondents 5 to 9 from quarrying the sand from her land. Hence, this Writ Petition.

Heard learned counsel for the petitioner as well as learned Government Pleaders for Mines & Geology and Revenue. Since the grievance of the petitioner being limited, ends of justice would be better served if a direction is issued to Respondents 1 to 4 to consider the representations submitted by her.

The Writ Petition is therefore, disposed of, directing Respondents 1 to 4 to consider the representations said to have been submitted by the petitioner and pass necessary orders thereon, as early as possible. No costs.

Consequently, the miscellaneous Applications, if any shall also stand disposed of.
