THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.10723 OF 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioners/Accused Nos.4, 6 and 18 in Crime.No.248 of 2023 on the file of Principal District and Sessions Court, Siddipet, registered for the offences under Sections 143, 147, 148, 448, 427 and 436 r/w. 149 of IPC.

Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the respondent-State and perused the record.

The case against these petitioners is that on 02.10.2023, there was an incident where these petitioners and several others attacked the house of the victim and burned it. The reason is that a person by name Naveen who was residing in the house was responsible for committing murder and to avenge the same, it is alleged

that these petitioners and others attacked the said house and set fire to the house.

Learned Assistant Public Prosecutor on instructions would submit that there are differences and enmity in between the parties and the release of the petitioners may result in further disputes amongst the parties. 5.

However, keeping in view that the incident was a result of retaliation to the alleged murder committed by said Naveen, this Court deems it appropriate to grant the relief of regular bail to the petitioners who are in jail since 06.10.2023, subject to following conditions:- i) The petitioners/Accused Nos.4, 6 and 18 shall execute personal bond for a sum of Rs.10,000/- (Rupees Ten thousand only) with two sureties for a like sum each to the satisfaction of Judicial First Class Magistrate, Dubbaka.

ii) The petitioner/Accused No.4 after release shall appear before the concerned Station House Officer at 10:00 a.m. everyday for a period of two weeks and thereafter, as and when required for the purpose of investigation. As far as petitioners/A-6

and A-8 are concerned, they shall appear as and when required.

iii) If it is found that these petitioners in any manner misuse the bail granted, the Police are at liberty to file an application seeking cancellation of bail granted.

(iv) The petitioners/Accused Nos.4, 6 and 18 shall abide by the other conditions stipulated under Section 437(3) of Cr.P.C.

Accordingly, this Criminal Petition is allowed.

Miscellaneous applications, pending if any, shall stand closed.
