HON'BLE SRI JUSTICE S.V. BHATT W.P.No. 26990 of 2016 O R D E R:- The petitioners pray for the following relief: " ....to issue a writ of mandamus declaring the action of the 3rd respondent in threatening to dispossess the petitioners, while existence of the assignment, without following due process of law, as illegal, arbitrary and in violation of principles of natural justice and to consequently direct the 3rd respondent not to interfere with the possession of the petitioners over their respective houses bearing Door Nos.
65-3-694, 65-3-692 and 65-3-693 in Plot Nos.138, 133A and 181 in Sy.No. 38 of Ex-Servicemen Colony, Gullalapalem, Visakhapatnam." On 12.08.2016, this Court in W.P.M.P.No. 33416 of 2016, made the following order:
" Notice.
Status quo as on today shall be maintained with regard to the possession of the subject property. However, this will not preclude the respondents from proceeding in accordance with law."
The respondents, in spite of receipt of notice, have neither filed counter affidavit nor sent instructions in the matter.
Having regard to the above circumstances, I am satisfied that the writ petition can be disposed of by making the Status Quo as final order and further direct the 3rd respondent - Tahsildar to cause inspection and verify physical features and possession of the subject matter of the writ petition after issuing notice to the petitioners, and if
SVB,J WP_26990_2016 circumstances warrant interference with the petitioners' possession, such action shall be in accordance with law. Accordingly, the writ petition is disposed of. No order as to costs.
As a sequel, Miscellaneous Petitions, if any pending, shall stand disposed of as infructuous.
