Learned counsel for the Revenue fairly states that the question raised in the instant appeal is squarely covered by the judgment of the Supreme Court in I.C.D.S LTD. v. CIT and, hence, the question may be answered against the Revenue and in favour of the assessee.

In view of the submission made by learned counsel for the Revenue, the appeal is dismissed answering the question against the Revenue and in favour of the assessee, in terms of the judgment of the Supreme Court in I.C.D.S Ltd.
