THE HONOURABLE SRI JUSTICE P. KESHAVA RAO CRIMINAL PETITION No.4450 of 2013 ORDER:

Heard learned counsel for the petitioner as well as learned Special Public Prosecutor (TG) for the respondents. The prayer sought for in this criminal petition is as under: ".... To quash the proceedings in FIR No.13/ACBCR-I/2010, dated 30.7.2010 on the file of the Police Station, Anti Corruption Bureau, City Range-I, Hyderabad".

During the course of arguments, it is brought to the notice of this Court by learned Special Public Prosecutor that the investigation was completed and charge sheet was already filed. The Court below, after taking cognizance of the offences, numbered the case as C.C.No.4 of 2014. Further, the petitioner herein filed Crl. MP.No.669 of 2014 for discharge and the same is coming for arguments on 04.04.2018 on the file of Additional Special Judge for SPE and ACB cases-cum-V Additional Chief Judge, City Civil Court, Hyderabad. Therefore, he would contend that the criminal petition has become infructuous and the same is liable to be dismissed.

A perusal of the material would indicate that the present criminal petition is filed to quash the proceedings in FIR.No.13/ACB-CR-I/2010, dated 30.7.2010. Admittedly, when the charge sheet is filed and cognizance is taken by the Court

below, no further cause would survive in the present criminal petition for adjudication.

Accordingly, the criminal petition is dismissed as infructuous.

Consequently, miscellaneous petitions pending if any, shall stand closed.
