THE HON'BLE SMT. JUSTICE P.MADHAVI DEVI W.P. No.37421 of 2022 ORDER:

This Writ Petition has been filed seeking a writ of mandamus, to issue a direction to the respondents to consider the Appeal filed by the petitioner dated 10.12.2021 as well as the representation dated 22.09.2022 for change of local cadre on the ground that the petitioner's son is suffering from mental retardation.

Heard the learned counsel for the petitioner and the learned Government Pleader for Services-I.

Learned counsel for the petitioner submits that the petitioner has already filed an Appeal before the respondent No.1 on 10.12.2021 and a representation dated 22.09.2022 to the respondent No.2, but, no orders have been passed on the said Appeal and representation so far. The copy of the Disability Certificate of the petitioner's son is also annexed herewith. He further submits that the case of the petitioner may be directed to be considered by the respondents under the guideline No.22 of G.O.Ms.No.317, G.A.(Ser.I) Department, dated 06.12.2021.

Learned Government Pleader for Services-I submits that the representation of the petitioner will be considered in accordance with law by the authorities.

Having regard to the rival contentions and material available on record, this Court deems it fit and proper to direct the respondent authorities to consider the Appeal dated 10.12.2020 as well as the representation dated 22.09.2022 under the guideline No.22 of G.O.Ms.No.317, G.A.(Ser.I) Department, dated 06.12.2021 and pass appropriate orders thereon within a period of four (4) weeks from the date of receipt of a copy of this order.

The Writ Petition is accordingly disposed of. There shall be no order as to costs Miscellaneous applications, if any pending, shall also stand dismissed.
