Aakula Prabhakar, S/O. Ojaiah, v. The State Of Telangana, Rep By Its Principal
HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 13261 of 2016 ORDER:
1) Heard learned counsel for the petitioners, Government Pleader for Revenue and Sri J.Kanakaiah, learned counsel appearing for un-official respondents.
2) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of respondent Nos.2 to 6 in not taking action on the representations, dated 09.03.2016 and 21.03.2016 and consequently failing to seize the borewell of respondent Nos.7 and 8, as arbitrary, illegal and contrary to the provisions of the Andhra Pradesh Water, Air, Land and Trees act, 2002; and consequently to direct respondent Nos.2 to 6 to consider the representations submitted by the petitioners at the earliest.
3) By an order dated 20.04.2016 this Court, granted interim direction.
4) It is represented that though there is an interim order to consider the representations dated 09.03.2016 and 21.03.2016, no orders are passed by the Revenue Divisional Officer till date. The grievance of the learned counsel for the un-official respondents is that the Tahsildar seized the borewell of the un-official respondents by acting in an illegal manner. If that is so, it is always open to the respondents to avail the remedy available
under law. Since the request of the petitioners is to consider their representations, the Revenue Divisional Officer, before whom the representations are made, shall pass appropriate orders on the representations made by the petitioners, in accordance with law, as expeditiously as possible, preferably, within a period of four (04) weeks, after hearing the petitioners and un-official respondents. A copy of the order passed shall be furnished to all the parties forthwith.
5) With the above direction, the writ petition is disposed of. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed. There shall be no order as to costs. _________________________ JUSTICE C. PRAVEEN KUMAR 09.02.2017 gkv
