HON'BLE SRI JUSTICE U.DURGA PRASAD RAO Writ Petition No.24643 of 2009 ORDER:

The petitioner seeks Writ of Mandamus declaring the action of the 3rd respondent insofar as directing the petitioner to pay Rs.1,90,000/- (Rupees One Lakh Ninety Thousand only) vide proceedings Notice No.PCO/GM-P/APRSCL/CNGR/2009 dt.24.09.2009 even though the petitioner has paid entire amount well in advance as demanded by the respondents vide proceedings Notice No.96/GM-P/APRSCL/CNGR/ 2007 dt.16.09.2008 of the 3rd respondent is illegal, arbitrary and violative of Articles 14 and 16 of the Constitution of India and consequently quash the proceedings Notice No.PCO/GM-P/APRSCL/CNGR/2009 dt.24.09.2009 of the 3rd respondent.

2) When the matter came up for hearing, learned counsel for petitioner would submit that this Court in W.P.M.P.No.32040 of 2009 passed interim order dated 13.11.2009 to the effect that the operation of proceedings Notice No.PCO/GM-P/APRSCL/CNGR/2009 dated 24.09.2009 has to be suspended on the condition of the petitioner depositing Rs.90,000/- (Rupees Ninety Thousand only) within a period of four(4) weeks. Learned counsel would further submit that in compliance of the said direction, the petitioner deposited Rs.90,000/- with the respondents and the respondents in turn executed registered sale deed in favour of the petitioner in respect of the subject flat and therefore, no

further orders need to be passed in the writ petition and the same may be closed.

3) Recording the above submission of learned counsel for petitioner, this Writ Petition is closed. No costs.

As a sequel, miscellaneous applications, pending if any, shall stand closed.
