THE HON'BLE SRI JUSTICE R.KANTHA RAO WRIT PETITION No.8910 OF 2015 ORDER:
Heard the learned counsel appearing for the petitioner, and the learned Government Pleader for Civil Supplies for the State of Telangana. A show cause notice dated 27.03.2015 was issued to the petitioner by the District Supply Officer proposing to cancel the food grains license issued under the A.P. Scheduled Commodities Dealers (Licensing, Storage and Regulation) Order, 2008 and calling for his explanation. The petitioner filed the Writ Petition on 30.03.2015. This Court is of the view that against the issuance of mere show cause notice, this Court is not supposed to exercise the writ petition under Article 226 of the Constitution of India to set aside the same. Therefore, the petitioner is directed to submit explanation within a period of two (2) weeks from the date of receipt of a copy of this order to the aforementioned show cause notice, and thereafter the fourth respondent is directed to pass appropriate orders on the said show cause notice in accordance with law.
Accordingly, the Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous petitions pending, if any, in this Writ Petition shall stand closed. ______________ R.KANTHA RAO, J Date: 01.04.2015 MVA
