THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.10701 OF 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused No.3 in Crime.No.145 of 2016 on the file of Achampet Police Station, Nagarkurnool District, registered for the offences under Sections 384, 385, 386, 120(b), 395 of IPC & Section 25(1)(A) and 27 of I.A. Act.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State and perused the record.

The petitioner is allegedly an associate one Nayeem/A-1, who died in a Police encounter. It is alleged that A-1 had committed several offences of extortion and criminal intimidation. This petitioner is alleged to be an associate of said Nayeem.

On instructions, learned Additional Public Prosecutor submits that the petitioner is involved in four other crimes.

Keeping in view that the petitioner is in jail since 14.10.2022, the prayer for regular bail can be considered, subject to following conditions:- i) The petitioner/Accused No.3 shall execute personal bond for a sum of Rs.1,00,000/- (Rupees One lakh only) with two sureties, for a like sum each to the satisfaction of the Judicial First Class Magistrate at Achampet.
ii) The petitioner/Accused No.3 after release shall appear before the concerned Court on every date of hearing.
(iii) Any attempt to contact any of the witnesses in the crime, the bail granted to the petitioner is liable to be cancelled.
iv) The petitioner/Accused No.3 shall abide by the other conditions stipulated under Section 437(3) of Cr.P.C. 6.
Accordingly, this Criminal Petition is allowed.
Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
