THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.10694 of 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused No.1 in Crime No.810 of 2023, on the file of P.S., S.R.Nagar, Hyderabad, registered for the offences punishable under Sections 417, 420, 506 and 509 of Indian Penal Code (for short 'IPC'). 2.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State and perused the record.

Briefly, the facts of the case are that the victim girl and this petitioner were moving closely as friends. They were classmates in the College. On account of their closeness, marriage was proposed in between them. The case of the prosecution is that in the year 2018, marriage proposal was accepted and in the year 2020, there was sexual intercourse even prior to their marriage. The victim girl was taken to Oyo room at Shamshabad and also at other places where they had physical relation. However, the petitoner did not marry

the victim girl as promised on account of difference between the parents of the petitioner and the victim girl. 4.

Keeping in view that the petitioner and victim girl being majors and they were having physical relationship over a period of three years, the prayer for regular bail is considered subject to the following conditions:

i) The petitioner/Accused No.1 shall execute personal bond for a sum of Rs.25,000/- (Rupees Twenty Five thousand only) with two sureties for a like sum each to the satisfaction of the III Addl. Chief Metropolitan Magistrate, Hyderabad.

ii) The petitioner/Accused No.1 after release shall appear before the concerned Station House Officer on every Monday and Wednesday for a period of eight

(08) weeks and thereafter, as and when required, for the purpose of investigation.

iii) The petitioner/Accused No.1 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C.

iv) The petitioner/Accused No.1 shall not in any manner contact the victim or her relatives, failing which, the police are at liberty to seek cancellation of the bail.

Accordingly, this Criminal Petition is allowed.

Miscellaneous applications, pending if any, shall stand closed.
