Learned counsel for petitioners submits that the petitioners have availed remedy of appeal either against the perceived inaction or action of respondents in not allotting fair price shops to petitioners pursuant to selection process undertaken in the Kakinada Division. As the petitioners cannot simultaneously pursue both the remedies, this Court is of the view that the writ petition fails and is dismissed by giving liberty to petitioners to pursue the remedy of appeal already filed and pending before the authority concerned. With the above observation, the writ petition is dismissed. No order as to costs.
