Petitioner is working as Field Assistant. Present writ petition is filed challenging the order impugned suspending the petitioner from service. On the same day, petitioner was also served with charge memo calling upon her to submit her explanation on the allegation leveled therein. According to petitioner, explanation was submitted, but so far the issue is not finalized. 2.

It is not in dispute that Project Director is not competent to place the petitioner under suspension. The suspension is resorted to as allegations are made against petitioner. Per se order of suspension cannot be held as illegal.

Learned senior standing counsel, on instructions, would submit that enquiry would be completed within four weeks. 4.

Having regard to the said submission, without going into merits, Writ Petition is disposed of, directing the Project Director to finalize the disciplinary proceedings and to pass appropriate orders as warranted by law within a period of four weeks from the date of receipt of copy of this order. If for any reason, disciplinary proceedings are not concluded within the time stipulated, not attributable to petitioner, petitioner shall be reinstated into service.
