HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND HON'BLE SRI JUSTICE S.V. BHATT WRIT APPEAL No. 674 OF 2005 JUDGMENT: (per the Hon'ble the Acting Chief Justice Dilip B. Bhosale) Heard learned counsel for the parties.

We have perused the order passed by learned Single Judge and also the prayers in the writ petition. In the writ petition the petitioner challenged G.O.Ms.No.51, dated 22.05.1999, issued under the provisions of the Standards of Weights and Measures (Enforcement) Act, 1985 (for short, "the Act").

We are informed by learned counsel for the respondents that the Act itself has been repealed and thereby the writ appeal has rendered infructuous.

Having confronted with this, learned counsel for the appellant could not and did not dispute the submission made by learned counsel for the respondents.

Hence, we dispose of the writ appeal as infructuous. Miscellaneous petitions, if any, shall also stand disposed of. There shall be no order as to costs.
