The petitioner challenges notice dated 18.10.2016 issued by respondents 4 and 5 as illegal and arbitrary. The standing counsel, on instructions, submits that the Grampanchayat in fact, has taken steps for laying a pipeline and in the process, the 4th and 5th respondents have removed the existing public water connection and have reconstructed the tap at a distance of 10' from the original connection. The complaint in the instant notice is that the petitioner has taken connection illegally and for which the explanation is sought for. It is further stated that the petitioner if gives explanation and satisfies that the connection to his house is according to law, the same will be considered or otherwise appropriate action will be taken.
The statement is placed on record. The petitioner is given one more week from today to submit explanation to the notice dated 18.10.2016. Respondents 4 and 5 are directed to consider the representation and pass orders in accordance with law. The writ petition is disposed of. No order as to costs.
