HON'BLE SRI JUSTICE M.S.K.JAISWAL CRIMINAL PETITION No.11150 of 2016 ORDER :

This Criminal Petition is filed under Section 482 of Cr.P.C. by the petitioner/A5 seeking to quash C.C.No.53 of 2014 on the file of I-Additional Judicial Magistrate of First Class, Tadepalligudem, for the offences under Sections 419, 420, 406, 468 & 471 of IPC, Section 4 r/w. 14 of Foreigners Act, Section 66 (C&D) of I.T. Act and Section 12 (1)(A)(B) of Passport Act. Heard learned counsel for petitioner and the learned Public Prosecutor and perused the material available on record. On a perusal of the charge sheet, this Court is of the view that truth or otherwise of the allegations made against the petitioner can be decided only after due trial. Hence, this Court is not inclined to interfere with the proceedings against the petitioner.

In the facts and circumstances of the case and as requested by the learned counsel for the petitioner, the Criminal Petition is disposed of, directing the Court below to proceed with the trial and dispose of C.C.No.53 of 2014 within a period of six months from the date of receipt of copy of this order, without seeking further extension of time.
