HON'BLE SRI JUSTICE R. KANTHA RAO Writ Petition No.12187 of 2015 ORDER:

Heard the learned counsel appearing for the petitioner and the Government Pleader for the Civil Supplies (TS).

2. This writ petition is filed seeking writ of Mandamus declaring the action of the 3rd respondent in issuing the suspension order in proceedings dated 24.01.2015 suspending the authorisation of petitioner's fair price shop No.21, at D.No.10-83 Gram Panchayat Road, Gram Panchayat Office, Medchal Village & Mandal, Ranga Reddy District, without issuing any show cause notice and without giving an opportunity to the petitioner to file her written explanation, as illegal and arbitrary and for a consequential direction to restore the authorisation of the petitioner.

3. The fair price shop of the petitioner was inspected on 16.01.2015 and the authorities allegedly noticed certain variations in the stock. Thereafter, by order dated 24.01.2015, the 3rd respondent-Revenue Divisional Officer, Malkajgiri suspended the authorisation pending enquiry. Thereafter, no enquiry was initiated till today and the authorisation is still kept under suspension.

4. Under these circumstances, the writ petition is disposed of directing the Revenue Divisional Officer, Malkajgiri Division, to conduct enquiry against the petitioner and pass final orders within a period of eight (8) weeks from the date of receipt of a copy of this order. Miscellaneous applications, if any, shall stand closed. No order as to costs.
