HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.29504 OF 2017 ORDER:

The case of the petitioner is that the 2nd respondent is issuing provisional Seniority list in Memo Rc.No.11648/E1/DPC/2016, dated 23-05-2017 and calling for the objections.

The petitioners gave objections dated 30-05-2017 to the 2nd respondent and on that the 2nd respondent addressed a letter in Rc.No.11648/E1/DPC/2016, dated 08-06-2017 to the 1st respondent requesting to follow the vertical seniority list. Inspite of the same, the 1st respondent without taking into account the recommendations made by the 2nd respondent is seeking to fill-up the posts of Special Grade Civil Surgeons by following horizontal seniority. Aggrieved by the same, the present writ petition is filed. Learned counsel for the petitioners submits that the rules have already been amended basing on the judgment of Supreme Court in Dr.N.Ramachandra Rao v. State of Andhra Pradesh1.

Heard learned Assistant Government Pleader for Services. Since, the petitioners have already filed objections to the provisional seniority list, it is for the respondents to take decision basing on the judgment of Supreme Court referred to above and amended rules in G.O.Ms.No.8, dated 30-01-2004. In view of the same, the respondents are directed to consider the objections of the petitioners and finalize the 1 1990(3) SCC 590

seniority list by taking into account the recommendations made by the 2nd respondent before affecting the promotions to the Special Grade Civil Surgeons.

With the above direction, the writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 04-09-2017 Nvl
