THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.28384 of 2016 ORDER:
This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:
"to issue writ of Mandamus to declare the inaction of the 2nd and 3rd respondents in issuing the pattadar pass books and title and mutation of name of the petitioner in the revenue records in respect of the Agriculture land admeasuring Ac.1.21 guntas in Sy.No.26/AA, an extent of Ac.0.11 guntas in Sy.No.105/RU and an extent of Ac. 0.05 guntas in Sy.No.16/E totally admeasuring Ac.1.37 guntas situated at Dabilguda Revenue Village, Maheswaram Mandal, Ranga Reddy District as arbitrary, illegal, void abinitio and contrary to the provisions of AP Record of Rights and Pattadar Pass Books Act and further may be pleased to direct the 2nd and 3rd respondents to mutate the name of the petitioner as pattadar in the revenue record and also issue the pattadar pass book and title deed to the petitioner in respect of the Agriculture land admeasuring Ac.1.21 guntas in Sy.No.26/AA, an extent of Ac.0.11 guntas in Sy.No.105/RU and an extent of Ac.0.05 guntas in Sy.No.16/E totally admeasuring Ac.1.37 guntas situated at Dabilguda Revenue Village, Maheswaram Mandal, Ranga Reddy District."
Heard, Sri J. Ashvini Kumar, learned counsel for the petitioner and learned Government Pleader for Revenue for the respondents.
When the matter is taken up, it is submitted by learned counsel for the petitioner that the issue involved in the present writ petition is squarely covered by the order, dated
25-03-2015, passed by this Court in W.P.No.7796 of 2015 and a copy of the same is also placed on record along with the writ petition as material papers.
Following the same, the writ petition is disposed of directing respondent No.3 - Tahsildar, Maheswaram Mandal at Maheswaram, Ranga Reddy District to consider the application, dated 04-03-2016, submitted by the petitioner in Form 6(A) and pass appropriate orders thereon, within a period of three (3) months from the date of receipt of a copy of this order. Miscellaneous Petitions pending, if any, shall stand closed. There shall be no order as to costs.
