The petitioner, who is accused in Crime No.924 of 2015-16 of Prohibition & Excise Station, Narsipatnam, Visakhapatnam District, filed the present application under Sections 437 and 439 Cr.P.C. seeking enlargement on bail in the above crime which was registered for an offence punishable under Section 8 (c) read with Section 20 (b)(ii)(c) of NDPS Act.

The case of the prosecution is that basing on the information received about the illegal transportation of ganja on 29-01-2016, the Narsipatnam Prohibition & Excise Police while conducting raid, found the accused in possession of 55 kgs. of ganja from petitioner/accused, as such the present complaint.

The learned counsel for the petitioner submits that the petitioner is innocent and that he is falsely implicated in the offence.

The learned Public Prosecutor opposed the bail application.

A perusal of the Case Diary shows that 55 Kgs. of dry ganja, which is commercial quantity, is found in the possession of the petitioner. Considering the same and in

view of the bar under Section 37 of NDPS Act, I am not inclined to grant bail to the petitioner.
