HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY W.P. No. 24408 OF 2012 ORDER :

This writ petition is filed seeking writ of mandamus directing the respondents authority to pass appropriate orders to issue the pattadar pass books, title deeds and incorporate names of the decree holders I the revenue record by way of issuing the mutation proceedings by complying the Court judgment and final decree in O.S.No.195/1976 passed by the II Additional Senior Civil Judge, City Civil Court, Hyderabad and consequently to direct the respondent authorities to pay exemplary costs.

2. Heard learned counsel for the petitioner and learned Assistant Government Pleader for Revenue.

Though the writ petition is filed for issuing mutation proceedings in terms of judgment and decree in O.S.No.195 of 1976 passed by the II Additional Senior Civil Judge, City Civil Court, Hyderabad, the petitioner's application for mutation was already dismissed vide proceedings dated 17.02.2011.

The petitioner himself filed proceedings dated 17.02.2011 in material papers, wherein the 4th respondent has rejected the application of the petitioner on the ground that interim stay has been granted by this Court in CCCA (SR) No.2809 of 2010 filed against the judgment and decree in O.S.No.195 of 1976.

4. Learned counsel for the petitioner also brought to my notice that CCCA (SR) No.2809 of 2010 was dismissed by this Court by common order dated 21.08.2014.

5. In view of dismissal of CCCA (SR) No.2809 of 2010, the 4th respondent now can dispose of the application of the petitioner. Without going into the merits of the case, petitioner is permitted to make a fresh application by enclosing the certified copy of the

judgment and decree dated 21.08.2014 in CCCA (SR) No.2809 of 2010 by stating facts and on such application, the 4th respondent to pass appropriate orders, after issuing notice to all the affected parties, in accordance with law.

With the above direction, this writ petition is disposed of. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in this writ petition, shall stand disposed of.
