THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No. 8646 of 2017 ORDER:

This writ petition was filed challenging the action of respondent No.4-Station House Officer, Mummidivaram Police Station in allowing respondent No.5 to trespass into the house of the petitioners.

Learned Government Pleader for Home, on the basis of written instructions, submits that petitioner No.1 lodged a complaint on 03.03.2017 before respondent No.4 stating that his daughter-in-law, respondent No.5 herein, and others tried to trespass into their house. Based on the same, Crime No.37 of 2017 was registered and the investigation is under progress. Except registering the said complaint, no coercive steps were taken against the petitioners nor allowed respondent No.5 to trespass into their house as alleged by the petitioners. Earlier, respondent No.5 lodged a complaint and the same was registered as Crime No.32 of 2015 and the complaint of petitioner No.1 was also registered as Crime No.26 of 2015. However, in respect of Crime No.26 of 2015, a final report was filed before the learned Judicial Magistrate of First Class, Mummidivaram, on 02.12.2015 stating that it was false. The petitioners did not file complaint/representation to provide police

protection and as and when they approach the Police, they would take action in accordance with law.

In view of the above, no further orders are necessary in the present writ petition.

The writ petition is accordingly closed.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs. ________________________ A.RAMALINGESWARA RAO,J Dt:23.03.2017 kdl
