HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO Writ Petition No. 25202 of 2016 Order:

The petitioner is the wife of the deceased driver who died on 17.05.2013 while working in the first respondent-Corporation. She states that she has two sons and two daughters and her second son got a job in the Police Department even before the death of her husband. She states that his second son is living separately along with his family. Now, the petitioner is living along with her elder son and unmarried daughter. She states that after the death of her husband there is no bread winner in the family and accordingly she submitted an application for providing employment to her elder son. The said application was rejected on the ground that one of her sons was already employed and the application was made for the post of Junior Assistant which cannot be considered as per the Rules. She submitted another representation on 19.01.

2016 stating that her second son was living separately and sent another representation in June 2016. She states that Circular No.PD-30/2000, dated 05.05.2000, clearly states that if one of the children is already employed and divided himself, the application of another child can be considered under Bread Winner Scheme. When her representations were not considered in the light of the above circular, the present Writ Petition is filed.

2. Even after issuing notice before admission and posting the matter after four weeks, no counter affidavit is filed by the respondents.

In the circumstances, this Writ Petition is disposed of directing the respondents 2 and 3 to consider the representation of the petitioner dated 19.01.2016 in the light of the Circular No.PD-30/2000, dated 05.05.2000, and also the subsequent circulars issued from time to time and pass appropriate orders thereon within a period of three (3) months from the date of receipt of a copy of this order. There

shall be no order as to costs.

4. As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
