THE HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No.8591 OF 2011 ORDER:

This writ petition was filed challenging the action of the respondents 2 and 3 in allowing installation and erection of cell tower in Door No.24-2-139, Santhi Nagar, Nellore City. This Court by order dated 30.03.2011 granted interim stay of installation of Cell Tower in the said premises for a period of eight weeks. After passing this order, Government regulated the activity of erection of Cell Towers by issuing G.O.Ms.No.2, MA & UD (M) Department, dated 1.1.2013 modifying G.O.Ms.No.183, MA & UD (M1) Department, dated 27.2.2008.

No counter-affidavit is filed by the respondents 2 and 3 till today. It appears from the record the representation was submitted by some of the neighbours against erection of Cell Tower in the above premises.

In the facts and circumstances of the case, this Writ Petition is disposed of directing the 2nd respondent to consider the representation submitted by the petitioner and others as per the existing Government Rules, while granting permission to 3rd respondent for erection of Cell Tower. No order as to costs. Miscellaneous applications, if any, pending in this Writ Petition shall stand closed.
