Garikapudi Samrajyam, v. The State Of Telangana,
THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.31733 OF 2017 DATED : 19.09.2017 Between :
Garikapudi Samrajyam D/o.Late Ramulu, Aged about 62 yrs, Occu : Retired Employee & Agriculture, R/o.Yedla Banjara (Gowraram), Uppalachalaka (Post), Penubali (Mandal), Khammam District ..
Petitioner And The State of Telangana, rep., by its Principal Secretary, Revenue Department, Secretariat, Hyderabad & others.
.. Respondents This court made the following :
- 2 - THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.31733 OF 2017 ORDER :
Heard.
2.
The limited grievance of the petitioner in the present writ petition is that according to her, she is in possession of land to an extent of Ac.0-26 guntas in Sy.No.494/KA/6 of Gouraram Revenue Village, Penuballi Mandal, Khammam District. Her father was granted 38-E patta, whereas, recently in the possessory column, the name of 5th respondent is reflected. Aggrieved by the same, this writ petition is filed.
3.
If what is contended in the affidavit filed in support of the writ petition is true, the remedy for the petitioner is to prefer appeal before the appellate authority against correction in the revenue records made by the Tahsildar. Admittedly, petitioner has not filed such appeal so far, but submitted a representation to the same authority.
4.
Once, an authority undertakes correction in the revenue records, even if it was made erroneously, the only remedy available to the aggrieved party is to prefer appeal.
5.
Thus, granting liberty to the petitioner to prefer appeal before the appellate authority, the Writ Petition is disposed of. It is needless to observe that if the appeal is preferred, the same shall be disposed of, as expeditiously as possible, preferably within a period of two (2) months from the date of filing of such appeal,
- 3 - after following the due procedure. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
