THE HON'BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.4109 of 2015 ORDER: (per the Hon'ble The Chief Justice Sri Kalyan Jyoti Sengupta) This Writ Petition filed under Article 226 of the Constitution of India, in our view, is not maintainable as the complaint of the petitioner relates to improper functioning of the alleged subordinate judiciary. We think that proceedings under Article 227 of the Constitution of India would be appropriate remedy as the High Court is having superintending power over the subordinate judiciary. Therefore, the Writ Petition is dismissed. However, liberty is given to the petitioner to approach appropriate forum in accordance with law. No order as to costs. Consequently, miscellaneous petitions, if any pending, shall stand closed.
