HIGH COURT FOR THE STATE OF TELANGANA: HYDERABAD MAIN CASE NO: Criminal Petition No.9926 of 2021 PROCEEDING SHEET 1.

30.06.2023 ML,J I.A.No.1 of 2023 This Court by order dated 03.01.2022 granted bail to the petitioner imposing certain bail conditions. Subsequently, the petitioner filed I.A.No.1 of 2022 seeking modification of one of the bail condition.

Accordingly, this Court by order dated 02.03.2022 modified the said condition.

Now, the present application is filed to relax the said modified bail condition, which is as follows:

"The application is accordingly, allowed and the condition that the petitioner shall reside within L.B.Nagar Police Station limits is modified and she is permitted to reside within the jurisdiction of Saidabad Police Station limits.

Further, she is permitted to enter into Gachibowli and Ramachandrapuram Police Station limits only on Thursday and Friday.

If there is any violation of the conditions and the petitioner tries to influence the witnesses, the police are at liberty to file an application seeking cancellation of bail."

Criminal Petition No.9926 of 2021 It is stated that subsequent to the above condition, the petitioner is staying outside her local area. Further, the wife of the victim is already examined and there is no scope for any tampering of evidence.

Learned counsel for the petitioner also stated that majority of the witnesses are examined. He also contended that there is no scope of influencing any other witness.

The fact that the person, who could be influenced was already examined and as majority of the witnesses are examined, the petitioner cannot be deprived from occupying her house.

Considering the subsequent developments in the case and reasons relied upon by the petitioner, the modified condition that 'the petitioner shall reside within L.B.Nagar Police Station limits is modified and she is permitted to reside within the jurisdiction of Saidabad Police Station limits. Further, she is permitted to enter into Gachibowli and Ramachandrapuram Police Station limits only on Thursday and Friday' is hereby dispensed with.

In the result, the petition is allowed.
