THE HON'BLE SRI JUSTICE C.PRAVEEN KUMAR WRIT PETITION No.26166 of 2018 ORDER:

1) Heard learned counsel for the petitioner and Government Pleader for Revenue (TG). With the consent of both the parties, the Writ Petition is being taken up for hearing at the admission stage itself.

2) The present Writ Petition came to be filed seeking issuance of writ of Mandamus to declare the action of the third respondent in refusing to register the sale deed dated 20.04.2018 pertaining to the property admeasuring 2700 square yards in House bearing GWMC H.No.6-1-21 (new), 6-1-140, 6/ 104 (old) situated at Kancharakunta, hanumakonda, Warangal, is illegal and arbitrary. The reason for rejection is that the 2nd respondent issued Draft Memo No.G2/ 19134/ 2011, dated 01.12.2011, directing the Sub-Registrars to refuse registration of the documents in pursuant to the interim injunction orders of the High Court of Madras. 3) When the writ petition is taken up for hearing, it is represented by the learned counsel for the petitioner that this Court in similar circumstances disposed of W.P.Nos.24316 and 24351 of 2013 W.P.No.39537 of 2015, directing the Sub-Registrar concerned to receive and process the documents presented by the petitioners therein without reference to the order dated 15.03.2011 of the High Court of Madras in Contempt Petition No.1205 of 2010.

4) In view of the above, the writ petition is disposed of, directing the Joint Sub-Registrar-I, Warangal, to receive and process the documents presented by the petitioner in respect of the subject lands without reference to the order dated 15.03.2011 of the High Court of Madras in Contempt Petition No.1205 of 2010. In the event the documents presented are found to fulfil the requirements of the Registration Act, 1908 and the Indian Stamp Act, 1899, the Joint SubRegistrar-I, Warangal, shall complete the registration formalities and release the documents in accordance with the due procedure. 5) Miscellaneous petitions, pending if any, shall stand closed in the light of this final order.
