THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.10707 of 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioners/Accused Nos.2 and 5 in Crime No.1448 of 2023, on the file of P.S., Meerpet, Rachakonda, registered for the offence punishable under Section 20(b)(ii)(B) of the Narcotic Drugs and Psychotropic Substances Act, 1985.

Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the respondent-State and perused the record.

The case of the prosecution is that the Meerpet police apprehended accused No.1 and found 1.5kg Ganja in his possession and also an amount of Rs.43,000/-. According to his confession, these petitioners who are his friends were also complicit of procuring the Ganja for selling it and making money.

Keeping in view that nothing was seized from these petitioners and only on the basis of confession of accused

No.1, these petitioners were arrayed as accused and further that the petitioners are being students, the prayer for regular bail can be considered subject to the following conditions: i) The petitioners/Accused Nos.2 and 5 shall execute personal bond for a sum of Rs.25,000/- (Rupees Twenty Five thousand only) each with two sureties for a like sum each to the satisfaction of the Metropolitan Sessions Judge, Ranga Reddy District at L.B.Nagar.

ii) The petitioners/Accused Nos.2 and 5 after release shall appear before the concerned Station House Officer on every Monday for a period of eight (08) weeks and thereafter, as and when required, for the purpose of investigation.

iii) The petitioners/Accused Nos.2 and 5 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C.

Accordingly, this Criminal Petition is allowed.

Miscellaneous applications, pending if any, shall stand closed.
