THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.6193 OF 2016 ORDER:
This Criminal Petition is filed by the petitioner-accused No.1 under Section 482 Cr.P.C. seeking to quash the proceedings against him in C.C.No.1327 of 2013 on the file of the XI Additional Chief Metropolitan Magistrate, Secunderabad.
Heard and perused the material available on record. The petitioner is alleged to have committed the offence punishable under Sections 420, 465, 468 and 471 r/w 34 IPC. It is alleged that the petitioner in the above C.C. impersonated the 2nd respondent and Mohd. Abdul Muqheed, fraudulently created documents in respect of their property. Further, the petitioner executed registered sale deeds in favour of A2 and A3 in respect of the property of the 2nd respondent and Mohd. Abdul Muqheed. Considering the facts and circumstances of the case and the nature of the offence, this Court is not inclined to quash the proceedings in the above case.
At this stage, the learned Counsel for the petitioner prayed for dispensing with the presence of the petitioner before the trial Court. In view of the above submission, the presence of the petitioner before the trial Court is dispensed with except on the date of framing of charges, if any; on the date of his examination under Section 313 Cr.P.C and on the date of pronouncement of judgment. The petitioner is directed to be represented through a Counsel before the trial Court on all hearing dates.
Accordingly, the Criminal Petition is disposed of.
Consequently, miscellaneous petitions pending, if any, shall stand
closed.
