HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.37352 OF 2016 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is preferred by the petitioners seeking the following relief: " ... to issue a Writ, Order or Direction more particularly one in the nature of Writ of Mandamus, declaring the inaction of the respondents, more particularly the inaction of the 4th respondent herein in not disposing the applications dated: 30.11.2006 made by the petitioners herein vide Revenue File Nos.

B/4897/2006, B/4901/2006, B/4900/2006, B/4898/2006, B/4899/2006 for mutation of their names in the revenue records as pattedar and possessors in respect of the lands to an extent of Ac.23.28 gts in Sy.Nos.563, 564, 587 & 589 belonging to 1st petitioner, an extent of Ac.20.21 gts in Sy.Nos.15, 16, 19, 20, 21 & 38 and an extent of Ac.0.20 gts in Sy.Nos.19 & 20 belonging to 2nd petitioner, an extent of Ac.32.09 gts in Sy.Nos.523, 524, 526, 591 & 593 belonging to 3rd petitioner and an extent of Ac.22.00 gts in Sy.Nos.

12, 32 & 49 belonging to 4th petitioner situated at Raghavapuram Village, Bibinagar Mandal, Nalgonda District as illegal, arbitrary, unconstitutional and against the principles of natural justice and consequently direct the respondents 2 to 4 to dispose of the applications pending before the 4th respondent by mutating the names of the petitioners in revenue records with respect to lands to an extent of Ac.23.28 gts in Sy.Nos.563, 564, 587 & 589 belonging to 1st petitioner, an extent of Ac.20.21 gts in Sy.Nos.15, 16, 19, 20, 21 & 38 and an extent of Ac.0.20 gts in Sy.Nos.19 & 20 belonging to 2nd petitioner, an extent of Ac.32.09 gts in Sy.Nos.523, 524, 526, 591 & 593 belonging to 3rd petitioner and an extent of Ac.22.00 gts in Sy.Nos.

12, 32 & 49 belonging to 4th petitioner situated at Raghavapuram Village, Bibinagar Mandal, Nalgonda District and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."

Heard the learned counsel for the petitioners as well as the learned Assistant Government Pleader for Revenue for respondents. With their consent, the writ petition is disposed of at the stage of admission itself.

Learned counsel for the petitioners mainly submits that in the year 2006 the petitioners have purchased land and got registered the same on 11.09.2006. Thereafter, the petitioners made an application on 30.11.2006 before the MRO for mutation of their names in revenue records. Pursuant thereto, the MRO is stated to have issued a notice calling for objections. It is stated that the petitioners have submitted all the required documents for mutation. It is said that in spite of giving number of representations, no orders are passed by the 4th respondent till date. It is further stated that the 2nd respondent also directed the 4th respondent to take necessary action on the application filed by the petitioners in accordance with law. The inaction on the part of the 4th respondent led to filing of the present writ petition. Learned AGP would submit that if the application of the petitioners is still pending consideration, the same may be directed to be disposed of at the earliest.

Having regard to the rival submissions made and without going into merits of the case, the Writ Petition is disposed of directing the 4th respondent-Tahasildar to consider the application dated 30.11.2006 made by the petitioners seeking mutation of their names in the revenue records, if the same is still pending consideration, and dispose of the same in accordance with law as

early as possible preferably within a period of six weeks from the date of receipt of a copy of this order.
