THE HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO C.R.P.No.149 of 2015 ORDER:

After hearing both sides, the learned counsel for the respondents states that Ex.A-55, the document filed by the respondents and is being relied upon by them (which is sought by the petitioners to be sent to an expert to determine whether it is a forgery or not) may be eschewed from consideration by the Court below and that the respondents will not rely on the said document for any purpose.

2. Having regard to the said submission, since Ex.A-55 is now being given up by the respondents/plaintiffs, there is no necessity to send the said document to an expert for seeking his opinion as to whether signatures thereon are forged or not.

3. Therefore, I.A.No.673 of 2014 in O.S.No.893 of 2007, out of which this Revision Petition arises, has become infructuous. Consequently the Civil Revision Petition is dismissed as infructuous. It is made clear that the respondents shall not be permitted to rely on Ex.A-55 for any purpose during the course of trial in the suit and the same is to be eschewed from consideration for any purpose. The Court below is directed to dispose of the suit expeditiously since it is of the year 2007. No costs.

As a sequel, the miscellaneous petitions pending, if any, shall stand closed.
