Heard learned counsel for the petitioner, learned Government Pleader for Revenue and Sri N.Praveen Kumar, learned Standing Counsel for Municipalities.

With the consent of both the parties, the writ petition is disposed of at the admission stage.

The grievance of the petitioner is that his representation dated 10.03.2016 seeking demolition of illegal constructions made by respondent No.4 in land bearing Survey No.609 of Yellandu Village and Mandal, Khammam District, is not considered till date. The averments in the affidavit filed in support of the writ petition would show that the petitioner who belongs to Scheduled Tribe made an application pursuant to the notification dated 15.09.2013 issued by M/s. Hindustan Petroleum Corporation Limited for grant of gas dealership in Yellandu Village and Mandal of Khammam District. It is averred that though the petitioner was qualified in all respects, respondent No.4 was granted dealership and letter of intent was also issued. On enquiry the petitioner came to know that the letter of intent was issued to respondent No.

4 basing on the material furnished by showing a piece of land in Survey No.609/1/33/A (old) 609/44 (new) of Yellandu Village and Mandal, Khammam District, for the purpose of constructing a gas godown. It is the case of the petitioner that the land in Survey No.609 of Yellandu Village is a Government land which has been leased out in favour of M/s. Singareni Colleries and as such respondent No.4 has no right to construct a gas godown in the said land.

dated 10.03.2016 seeking appropriate action against respondent No.4 for the illegality committed in the land. The inaction of the respondents in acting upon the representation dated 10.03.2016 lead to filing of the present writ petition.

Learned counsel appearing for respondent No.3 and also the learned Government Pleader submits that if any application is made, the same shall be dealt with, in accordance with law. Having regard to the facts stated above and without going into merits of the case, the present writ petition is disposed of directing respondent No.2 to consider the representation dated 10.03.2016 made by the petitioner, in accordance with law, after hearing the petitioner as well as respondent No.4 and dispose of the same, as expeditiously as possible, preferably within a period of two months from the date of receipt of a copy of this order.
