THE HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO CC.No.1954 of 2018 ORDER :

Heard the counsel for petitioner and Sri V. Narasimha Goud, learned Standing Counsel for Hyderabad Metropolitan Development Authority (H.M.D.A.), for respondents.

This Contempt Case is filed alleging willful disobedience of the order dt.10.04.2018 passed in WP.No.6639 of 2018. 3.

In the said order, this Court had directed the respondents herein to consider petitioner's application for building permission within three (03) weeks without reference to the building of a retaining wall on the Eastern side facing National Highway No.7 or the petitioner providing depth of 20' in the cellar as per G.O.Ms.No.168 dt.07.04.2012.

Though there is some delay in consideration of the petitioner's application for building permission, it is not in dispute that on 02.07.2018, the H.M.D.A. has issued a building permission to the petitioner subject to certain conditions.

Though the counsel for petitioner seeks to contend that some conditions now imposed in the order dt.02.07.2018 passed by the H.M.D.A. are illegal, since the petitioner has admittedly challenged the same in WP.No.24930 of 2018 before this Court, granting liberty

to the petitioner to pursue the said Writ Petition, this Contempt Case is closed. No order as to costs.

As a sequel, miscellaneous petitions pending if any in this Contempt Case, shall stand closed.
