THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.10708 of 2023 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by the petitioners/Accused Nos.6 and 7 seeking bail in connection with Crime No.396 of 2023 dated 18.10.2023 on the file of Musheerabad Police Station, Hyderabad, registered for the offences punishable under Sections 307 and 427 read with 34 of Indian Penal Code (for short 'IPC').

Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the respondentState and perused the record. 3.

The case of the de facto complainant is that he and his family members were attacked by group of more than seven persons on 18.10.2023. It is alleged that these petitioners who are arrayed as accused Nos.6 and 7 were also present when accused Nos.1 and 2 beat the victims with sticks. It is mentioned in the remand report of

accused Nos.1 and 2 that these petitioners and three others also joined and beat the victim with slippers and kicked them.

The incident appears to be outcome of difference between relatives. Since, bald allegations were made against these petitioners who are women that they have participated in injuring the victim.

However, in view of such bald allegations, this Court deems it appropriate to grant relief of anticipatory bail subject to the following conditions:-

1) The petitioners/Accused Nos.6 and 7 are directed to surrender before the Station House Officer, Musheerabad Town Police Station, Hyderabad on 06.11.2023.

Upon such surrender, the said Station House Officer shall release the petitioners/Accused Nos.6 and 7 on bail, on their executing personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with one surety for a like sum each to his satisfaction.

2) On such release, the petitioners/Accused Nos.6 and 7 shall appear before the concerned police, as and when required for the purpose of investigation.

3) The petitioners/Accused Nos.6 and 7 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
