HON'BLE SRI JUSTICE S. RAVI KUMAR Tr.CIVIL MISCELLANEOUS PETITION No.41 of 2014 ORDER:

This petition is filed to withdraw F.C.O.P.No.126 of 2013 from the file of Family Court-cum-V Additional District Judge, Tirupati, Chittoor District and transfer the same to Family Court, Kadapa, YSR District for disposal in accordance with law.

2. Petitioner herein is wife and she filed her affidavit in support of transfer petition, according to which, her marriage with respondent was performed on 15.02.2009, and due to disputes, they are living separately and there were cases filed earlier which were subsequently withdrawn, but respondent herein intentionally filed F.C.O.P.No.126 of 2013 before Family Court, Tirupati for divorce and that respondent is not residing at Tirupati and his working place is Pileru of Chittoor District. She further stated that she has a small child and it will be difficult for her to travel from Kadapa to Tirupati, covering a distance of 150 KMs and respondent is hale and healthy, who can travel from his working place to Kadapa, and for these reasons, she prayed for transfer of F.C.O.P No.126 of 2013 from Family Court-cum-V Additional District Judge, Tirupati, Chittoor District to Family Court, Kadapa, YSR District.

3. Respondent in spite of service of notice neither appeared in person nor through any advocate.

4. Heard advocate for petitioner.

5. I have perused the material papers filed along with

transfer petition. Considering the reasons stated in the affidavit and also considering the convenience of petitioner/wife, F.C.O.P.No.126 of 2013 is withdrawn from the file of Family Courtcum-V Additional District Judge, Tirupati, Chittoor District and transferred to Family Court, Kadapa, YSR District for disposal in accordance with law.

6. Accordingly, the Transfer Civil Miscellaneous Petition is ordered. No costs. Miscellaneous Petitions, if any pending, in this petition, shall stand closed.
