Heard learned counsel appearing for the petitioner and learned Government Pleader for Civil Supplies appearing for respondents 1 to 4.
This Writ Petition is filed seeking to declare the action of the 3rd respondent in suspending the authorization of the petitioner vide proceedings dated 27.01.2015, as illegal and arbitrary.
Learned counsel appearing for the petitioner submits that without conducting any enquiry, the 3rd respondent-Sub Collector has passed the impugned order.
On the other hand, learned Government Pleader for Civil Supplies would submit that after issuing notice and receiving the explanation from the petitioner, the impugned order was passed after conducting proper enquiry and that an appeal is pending before the Collector (CS), Prakasam District at Ongole.
Under these circumstances, the impugned order dated 27.01.2015 passed by the 3rd respondent is suspended and the respondents are directed to allot the essential commodities to the petitioner's fair price shop No.30 of Veluguvaripalem Village, Tallur Mandal,
Prakasam District, and continue him as fair price shop dealer in respect of the said shop, pending disposal of the appeal before the 2nd respondent-Collector (CS), Prakasam District at Ongole.
Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
